Ingram Library Services’ (“ILS”) and Indie Author Project (“IAP”) Survey and Giveaway Terms and Conditions

Important:

Please read these Terms and Conditions before completing the online survey and entering the promotional giveaway (the “Promotion”). By participating in the survey, you agree to be bound by these Terms and Conditions and represent that you satisfy all of the eligibility requirements below.


Eligibility
:
In order to be eligible for entry into the Promotion, you must be: a) a legal resident of the contiguous US or Canada and 18 years or older at the time of entry and b) an employee of a public library in the US or Canada.  


How to Enter:
Successfully complete the Public Library Survey between the dates of November 13, 2023, and December 22, 2023. Entrant must provide full name, e-mail address and represented library.

Upon successful completion of the Survey, the library you identify in your original entry will be entered for a chance to win one of three prizes:

  1. ILS will provide a one-time gap analysis of your library’s collection  to help you identify essential titles—whether classics, evergreen standards, or new releases—missing from your collection, valued at $1,000.
  2. ILS will provide your library with an indie author collection of books valued at $500.
  3. ILS will provide your library with an indie author collection of books valued at $500.

Failure to submit all required information or complete the Survey will result in disqualification. All entrants and entries are subject to verification by ILS. Entries will not be acknowledged or returned.

By entering the Promotion, you agree to being placed on ILS e-mail and marketing mailing lists to receive promotional updates, information and other marketing materials from ILS and/or our affiliated and subsidiary companies commonly known as Ingram Content Group for purposes of advertising services and offerings.  


Promotion Period:

The Promotion shall begin at 12:01 am (all times Central Standard Time) on Monday, November 13, 2023 and end at 11:59 pm on Friday, December 22, 2023.


Prize:

Three winning libraries will be randomly drawn from eligible entries and promptly notified to receive the following prizes:

  1. ILS will provide a one-time gap analysis of entrant’s library collection valued at $1,000 to be compelted by the end of 2024.
  2. An indie author collection of books valued at $500.
  3. An indie author collection of books valued at $500.  

The winning libraries will be contacted to arrange awarding of the prize and will be announced via e-mail to all entrants. To request confirmation of the winner, please submit a request to us within 30 days of the end of the Promotion Period to the attention of  ILS Promotions/ Marketing 14 Ingram Blvd. LaVergne, TN. 37086. We will confirm the Promotional Period ended and a winner was selected. Each prize must be fully redeemed and any gap analysis completed by December 31, 2024. All product awards will be shipped to the winning library’s U.S. address or designated U.S. freight forwarder. Winners outside the U.S. are responsible for all aspects of importation and clearance through customs including duties, fees, freight, and taxes associated with prizes. The prize must be accepted as awarded. No cash alternatives, substitution or transfers of the prize will be allowed. The winner is not entitled to the monetary difference between the actual prize value and stated approximate prize value, if any.  


Odds of Winning; Taxes; Etc.:

Odds of winning a prize depend on the number of eligible entries received. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNING LIBRARY. The prize may be forfeited and awarded to an alternative winner if two (2) attempts to contact winner by phone or e-mail are not successful, or if prize is otherwise not claimed or timely redeemed. No substitutions or exchanges (including for cash) will be permitted, except we reserve the right to substitute a prize of equal or greater value for any prize. Each prize is awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).


Use of Name and Likeness
. By participating in the survey, you hereby grant to ILS and its affiliates, subsidiaries, successors, and assigns and Indie Author Project the right and permission to use in perpetuity my name (and/or that of the business identified within), any likeness thereof, images, voice, recorded voice, appearance, biographical information, statements, trademarks, and/or testimonial(s) (collectively, “Appearance”) in any manner and in any media, now known or later developed, throughout the world, at any time, for the purpose of marketing efforts related to ILS or affiliated services without any right of prior review, permission or compensation of any amount or kind whatsoever. ILS shall have complete ownership of any recording, statements, picture, product, copy, presentation or other material or file containing or featuring your Appearance including copyright interests, and entrants acknowledge each has no interest or ownership in your Appearance (or any portion thereof) or its copyright.  This grant includes, without limitation the right for ILS and it affiliates to publish or have published, edit, abridge, augment, title, or create a compilation from my Appearance in whole or part as ILS may elect in its sole discretion.


Use of Personal Information and Survey Results
. By participating in this survey, you agree ILS and its affiliates, agents, employees, representatives, advisors, and promotional partners including Indie Author Project may collect, review, aggregate, copy, analyze, share, post, and otherwise publicly disseminate survey results, infographics, statistics and other aggregated forms of data including entrant’s personal information, associated library information and general interest data regarding the relationships between public libraries and their local author community for the purpose of identifying trends that may be emerging in terms of local writing programs and resulting market opportunities.

Ingram Library Services LLC, and our affiliates, directors, officers, consultants, professional advisers, employees and agencies (collectively, the "Released Parties") will not be responsible for: (a) any late, lost, misrouted, garbled, distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer or communications-related malfunctions or failures; (c) any Promotion disruptions, injuries, losses or damages caused by events beyond our control or by non-authorized human intervention; or (d) any printing or typographical errors in any materials associated with the Promotion. Void where prohibited. All entries submitted with the aid of any device capable of and with the purpose of generating automatic entries shall not be accepted.


Indemnity:
You agree to indemnify and hold ILS, Indie Author Project and each of itsagents, affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the "Indemnitees"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Indemnitees due to or arising out of the use of any element of your submission, including but not limited to claims for trademark infringement, copyright infringement, violation of an individual's right of publicity or right of privacy, data protection, or defamation.
